1 Introduction
These Terms & Conditions ("Terms") govern your access to and use of the GEO PhotoMark mobile application and admin panel (together, the "App"), operated by GEO PhotoMark ("we", "our", "us"). By downloading, registering with, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the App.
These Terms should be read together with our Privacy Policy, which explains how we collect, use and protect your data.
2 Eligibility & Account Registration
To use GEO PhotoMark you must:
- Be at least 13 years of age, or the age of digital consent in your country.
- Provide accurate, current and complete information when creating your account.
- Keep your login credentials confidential and notify us immediately of any unauthorized use of your account.
- Be solely responsible for all activity that occurs under your account.
If you are using the App as an employee or member of an organization, your organization's admin may also set additional rules for how you use the App within their workspace.
3 License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device that you own or control, solely for your personal or internal business use. You may not:
- Copy, modify, reverse-engineer, decompile or create derivative works of the App.
- Rent, lease, sell, sublicense or otherwise transfer the App to any third party.
- Remove or alter any proprietary notices, branding or location-verification watermarks generated by the App.
- Use the App in a way that violates any applicable law or infringes the rights of others.
4 Use of Core Features
GEO PhotoMark provides location-verified photo capture, notes, gallery, QR/barcode scanning, map themes and related tools. These features rely on your device's camera, GPS and network connectivity, and their accuracy may vary based on network signal strength, satellite visibility, indoor/outdoor conditions and device hardware.
Location, address and map data stamped on a photo reflect the reading provided by your device at the moment of capture and are intended as a verification aid, not an infallible legal record.
5 Check-In, Check-Out & Attendance
The App's Check-In and Check-Out features let you record location-tagged attendance selfies, subject to built-in rules such as a minimum gap between Check-In and Check-Out and a cooldown before a new Check-In. You agree to use these features honestly and not to attempt to bypass, spoof or manipulate location data to misrepresent your attendance or whereabouts. Where the App is deployed by your employer or organization, attendance records generated through the App may be used by that organization for HR, payroll or compliance purposes, and we are not responsible for how your organization uses such records.
6 Emergency SOS Feature
The Emergency SOS feature is designed to send your identity, timestamp and live location to your organization's admin or designated contacts when you tap the SOS button. This feature is a convenience tool and is not a substitute for contacting local emergency services (such as police, ambulance or fire services) directly in a genuine emergency.
We do not guarantee real-time delivery, response time or the availability of network connectivity required to send an SOS alert. Always call local emergency services first if you are in immediate danger.
Misuse of the SOS feature — including triggering false or malicious alerts — may result in suspension or termination of your account.
7 User Conduct & Responsibilities
When using the App, you agree that you will not:
- Upload or capture photos, notes or content that are unlawful, defamatory, obscene, or that infringe on another person's privacy or rights.
- Use fake GPS, VPNs or spoofing tools to falsify location data captured by the App.
- Attempt to gain unauthorized access to another user's account, the admin panel, or our servers and systems.
- Use the App to harass, stalk or track another individual without their knowledge and consent.
- Interfere with or disrupt the App's functionality, security or servers in any way.
8 Your Content & Ownership
You retain ownership of the photos, notes and other content you create using the App ("Your Content"). By using the App, you grant us a limited license to store, process and display Your Content solely for the purpose of providing and improving the App's features, such as gallery sync, cloud backup and admin reporting where applicable. You are responsible for ensuring you have the right to capture and store any photo or content you create through the App, including where third parties may appear in your photos.
9 Organization & Admin Accounts
Where the App is used by an organization, the organization's admin may be able to view attendance records, photo logs, GPS history and SOS alerts of users within that organization's workspace, as part of the admin dashboard functionality. If you are using the App under an organization's account, please refer to your employer's or organization's own policies regarding how this data is used internally, in addition to these Terms.
10 Intellectual Property
The App, including its design, logo, graphics, source code and features (excluding Your Content), is owned by GEO PhotoMark and is protected by copyright, trademark and other intellectual property laws. Nothing in these Terms grants you any right to use our name, logo or branding without our prior written consent.
11 Suspension & Termination
We may suspend or terminate your access to the App, in whole or in part, at any time — with or without notice — if we reasonably believe you have violated these Terms, misused a feature (such as SOS or Check-In), or engaged in activity that could harm the App, other users, or third parties. You may stop using the App and delete your account at any time from the App's Settings or via our Delete Account page.
12 Disclaimers
The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to accuracy, reliability, availability or fitness for a particular purpose. We do not warrant that location readings, timestamps, map overlays or SOS alerts will be uninterrupted, error-free or perfectly accurate at all times, as these depend in part on your device, GPS satellites, network operators and third-party map services beyond our control.
13 Limitation of Liability
To the maximum extent permitted by applicable law, GEO PhotoMark and its team shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, revenue or opportunity, arising out of or related to your use of, or inability to use, the App — including delayed or failed SOS alerts, inaccurate location data, or attendance disputes — even if we have been advised of the possibility of such damages.
14 Changes to These Terms
We may update these Terms from time to time to reflect changes in our App, features or legal requirements. We will notify you of material changes by posting the revised Terms in the App and updating the "Last updated" date above. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
15 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in India.
